Frank (Francis J.) Carney had a long career in civil litigation, but has limited his practice to mediation since 2009.

Serving as a defense lawyer in the medical malpractice, products liability, and personal injury arenas for eighteen years, he then for ten years acted as plaintiffs’ counsel in those areas. He also has represented financial institutions, dealt with hospital credentialing issues, and at one point or another handled nearly every kind of non-domestic civil litigation.

Frank has been actively involved in the revision of the Utah Rules of Civil Procedure and of the Utah Model Jury Instructions, as well as frequently lecturing on trial practice and civil procedure. He has tried or arbitrated cases involving everything from brain-damaged babies to legal malpractice. This gives him a unique perspective for the evaluation of your case.

Frank is a hands-on evaluative mediator who will understand your case, knows the Utah judicial system, has a deep knowledge of Utah law and procedure, and knows (and is known by) most litigators and judges in the state. He gets cases settled by direct and substantive analysis and discussion with counsel and their clients of the strengths and weaknesses of the claims and defenses.

Most common areas of mediation practice:

  •        Medical malpractice (~75/year)
  •        Wrongful death actions (1/4 to 1/3 of my mediations, most years)
  •        Trucking accidents
  •        SNF, Assisted Living, LTC claims
  •        Medical devices and other products liability claims
  •        Youth residential-facility and wilderness program claims
  •        Legal malpractice
  •        Section 1983 and civil rights actions
  •        Skier vs. skier and ski resort claims
